Law 54-23: Transfer of CNOPS Health Insurance to CNSS on 1 February 2027

Updated on June 12, 202614 min read

Published in Official Gazette no. 7470 on 29 January 2026, Law 54-23 organises the transfer of compulsory health insurance (AMO) for 4 million civil servants and dependants from CNOPS to CNSS. Effective 1 February 2027. Here is what changes, what stays the same, and why a top-up health policy becomes practically essential.

1. 1. Official Timeline: From Gazette to 1 February 2027

Law 54-23 followed a full legislative path before publication. The dates below come from the Official Gazette and Ministry of Health communications.

Key takeaway

No mandatory step before 1 February 2027: CNSS automatically takes over CNOPS files. But preparing your CNSS ID and dependants file from autumn 2026 prevents reimbursement gaps.

2. 2. Who Is Concerned: 4 Million Beneficiaries

The transfer covers the entire historical CNOPS perimeter, around 4 million people according to official figures.

  • Civil servants of the State (central and devolved administrations).
  • Staff of local authorities (municipalities, prefectures, regions).
  • Agents of public bodies affiliated to CNOPS.
  • Civil service retirees receiving a CMR or RCAR pension.
  • Spouses not covered by their own compulsory scheme.
  • Children dependants within the age limit set by law (see section 7).

Private sector workers already at CNSS

If you are already AMO-CNSS affiliated through a private employer, nothing changes for you. Law 54-23 only concerns current CNOPS beneficiaries.

3. 3. What Actually Changes: 5 Key Points

The transfer is not purely administrative: it changes five elements of daily life for insured persons.

3.1 Single manager

CNSS becomes the sole AMO manager for civil servants. CNOPS ceases its reimbursement activity from 1 February 2027.

3.2 Unified CNSS ID

The old CNOPS number is replaced by the CNSS ID, already used in the private sector. This ID is used for reimbursements, e-filing and the insurance card.

3.3 Insurance card

The CNOPS card becomes invalid on 1 February 2027. A new CNSS card is issued, in the same format as for private sector employees.

3.4 Reimbursement platform

Care forms and bordereaux go through CNSS agencies and the Damancom Santé portal. Files submitted to CNOPS before 31 January 2027 are processed under old rules.

3.5 Dependant age limit

The limit goes from 26 to 30 years for children in studies or without occupation, aligning with the private CNSS scheme.

4. 4. What Does Not Change

Several pillars of AMO remain identical after 1 February 2027.

  • Same care basket: the 65-00 law foundation applies to former CNOPS as to historical CNSS members.
  • Contribution rates maintained: employee and employer shares are unchanged in the text.
  • Hospital third-party payment: public hospital and convention clinic agreements preserved.
  • Pension and civil servant status: Law 54-23 does not affect status or CMR/RCAR retirement.
  • Dependants: spouse and children remain covered under the same family rules.

The care basket remains limited

Identical does not mean complete: basic AMO still does not cover certain out-of-list drugs, advanced dental prosthetics, or optics beyond ceilings.

5. 5. Unified CNSS ID: Steps to Anticipate

Allocation is automatic for the vast majority of civil servants, but a few cases require manual action.

5.1 Automatic case

If you are active and declared on the TGR payroll, your CNSS ID is generated and transmitted administratively. You receive it by mail or via the employer portal.

5.2 Cases to check

  • CMR/RCAR retirees: check that the pension is linked to the future CNSS file.
  • Dual activity (public + private): a single consolidated CNSS ID will be issued.
  • Spouse with their own activity: verify dependant status is preserved.
  • Children aged 26-30: submit a school or non-activity certificate.

5.3 Documents to prepare

  • Updated ID card for main insured and spouse.
  • Recent marriage certificate (less than one year if possible).
  • Birth certificates of dependant children.
  • Work or pension certificate.
  • Old CNOPS number (to merge care history).

6. 6. CNOPS → CNSS Card: Switch Procedure

The CNOPS card remains valid until 31 January 2027 included. From 1 February 2027, only the CNSS card allows coverage.

Do not throw away your CNOPS card

Keep the old card for at least 12 months after the switch: it may be requested to justify prior care or reimbursement files still under review.

7. 7. Dependant Children Up to 30

One of the most concrete evolutions of Law 54-23 is the extension of the age limit for dependant children.

  • Students aged 26-30: annual school certificate.
  • Graduates seeking employment: ANAPEC certificate or CNSS non-affiliation proof.
  • Children with disabilities: medical certificate, no age limit.
  • Married children: automatic removal from the dependants file.

Under CNOPS, coverage stopped at 26 (subject to studies or disability). Law 54-23 aligns this limit with the CNSS scheme, i.e. 30 years for student children or those without professional activity, and no age limit for children with disabilities.

8. 8. Risks Flagged by CESE

The Economic, Social and Environmental Council issued an opinion on 11 April 2026, highlighting several vigilance areas.

  • Risk of CNSS agencies being overloaded with 4M new beneficiaries while handling private files.
  • Reimbursement times potentially extended during the first 6 months of the switch.
  • Heterogeneity of information systems: technically complex CNOPS history recovery.
  • Risk of double affiliation for civil servants with dual activity.
  • Financial vigilance: overall AMO balance with absorption of a population with different claims patterns.

Minister Tehraoui's response

The Minister of Health clarified that this is an administrative integration — not a merger of schemes — and that CNOPS remains legally in place to manage transition and historical litigation.

9. 9. Top-up Mutuelles 2027-2028: MGPAP, OMFAM

Historical civil service mutuelles (MGPAP, OMFAM, etc.) do not disappear. A 2027-2028 agreement organises continuity of top-up coverage.

  • MGPAP: General Mutual of Public Administration Staff.
  • OMFAM: Social Works of the Moroccan Auxiliary Forces.
  • Ministerial mutuelles (Health, Interior, Justice, Finance).
  • 2027-2028 agreement: continuity of services, gradual alignment with the new manager.

In practice, mutual contributions remain payroll-deducted, and top-up reimbursements continue on top of the new CNSS scheme. The top-up basket covers items poorly handled by the AMO foundation: optics beyond ceiling, dental prosthetics, certain drugs, fee overruns.

10. 10. Why a Private Top-up Still Matters

Even with a public mutuelle and the new CNSS scheme, coverage gaps remain. A private top-up health policy fills these gaps.

  • Fee overruns in private clinics and with specialists.
  • Drugs outside the AMO basket and recent therapeutic innovations.
  • Optics: premium frames, progressive lenses, long-wear contacts.
  • Dental: implants, adult orthodontics, premium prosthetics.
  • Private hospital room and inpatient comfort.
  • Complementary medicine: osteopathy, acupuncture, psychology.

Compare before 1 February 2027

Subscribing to a top-up before the switch avoids the foreseeable insurer overload in early 2027 and lets you align effective dates with the end of CNOPS card validity.

11. FAQ

Q.When does Law 54-23 come into force?
On 1 February 2027. The law was published in Official Gazette no. 7470 on 29 January 2026, with a 12-month transitional period.
Q.How many people are affected by the transfer?
Around 4 million beneficiaries: active civil servants, CMR/RCAR retirees, spouses and dependant children currently managed by CNOPS.
Q.Do I need to take steps to obtain the CNSS ID?
No for most: CNSS automatically generates the ID from TGR and CNOPS data. Checking your file in late 2026 is still recommended.
Q.Is my CNOPS card still valid in 2027?
Yes, until 31 January 2027 included. From 1 February 2027, only the CNSS card allows healthcare coverage.
Q.Does the reimbursed care basket change?
No. Law 65-00 sets the common AMO foundation. Reimbursements and care basket remain identical after the transfer.
Q.Will my student children up to 30 be covered?
Yes. Law 54-23 aligns the limit with the private CNSS scheme: 30 years for children in studies or without activity, no limit for children with disabilities.
Q.Does MGPAP disappear with Law 54-23?
No. MGPAP and other public mutuelles keep their top-up role. A 2027-2028 agreement organises continuity with CNSS.
Q.What happens to CNOPS after 1 February 2027?
CNOPS remains legally in place to manage transition, litigation and prior care files. It no longer acts as AMO managing body.
Q.Is a private top-up insurance necessary on top?
Not mandatory but recommended. The AMO foundation leaves advanced dental, optics beyond ceilings, certain drugs and fee overruns to the insured.
Q.Is there a risk of reimbursement interruption in early 2027?
CESE warned of an administrative saturation risk. CNSS plans agency reinforcements and priority handling of urgent files during the first 6 months.
Q.Will contributions increase with the transfer?
Not in the law text: employee and employer contribution rates remain unchanged. A future evolution is possible depending on overall AMO financial balance.
Q.How do I check my file before the switch?
Contact your HR department or your CNSS agency from autumn 2026 to check the ID, household composition and dependant supporting documents.
